Brook v Boot [1928] satu pengajaran

Hari ini aku tertarik dengan satu kes yang diajar di dalam kelas Law of Tort by Prof Altaf. This case namely Brook v. Boot [1928]. I’m interested with the fact of the case that the 1st defendant is the owner of a land and rent into the Plaintiff. The plaintiff then uses one of the premises on the land as shop. My lecturer didn’t explained what type of shop it is. Since the 1st defendant is the landlord, he has an authority to access the premise for any safety inspection.
On that day, a man who is the 2nd defendant is smelling gas leaking. The 1st and 2nd defendant than enter the plaintiff’s shop to investigate what happen. The shop is so dark and 1st defendant advises the 2nd defendant to light on match. Due to that there was a big explosion in the shop and damage the plaintiff’s property.
The plaintiff claims damages and the court held that both defendant ore jointly liable for the damage.
What is my observation on this case is the defendants actually want to help the plaintiff from suffering any losses but this incident happened. Should we hold them liable in attempting to help each others. Kadang-kadang aku fakir law menyebabkan masing-masing tidak mempedulikan orang lain.
Sebenarnya banyak lagi aku nak tulis tentang this fact of the case and what I get from it, Cuma masa tidak mengizinkan
